IL HB3359

Amends the Juvenile Court Act of 1987 to prohibit automatic expungement of juvenile court and law enforcement records for minors adjudicated delinquent based on an attempt to commit a disqualified offense.

Adds language to Section 5-915(0.3)(a) excluding attempts to commit disqualified offenses from the 2-year automatic expungement provision that applies to other delinquency adjudications.

Disqualified offenses include serious crimes such as murder, sexual abuse, armed robbery, drug trafficking, weapons offenses, and various violent felonies under the Criminal Code of 2012.

Preserves existing expungement eligibility for other offense categories, including dismissals, not delinquent findings, supervision completions, and adjudications for misdemeanors and petty offenses.

Records related to attempts to commit disqualified offenses will remain subject to petition-based expungement under subsection (1) but will not automatically expire after 2 years like non-disqualified offense adjudications.
