IL HB3417

Removes the restriction preventing circuit courts from having jurisdiction over persons charged with felonies in mental health proceedings under the Mental Health and Developmental Disabilities Code.

Establishes circuit court jurisdiction over three categories: persons subject to involuntary inpatient admission, persons subject to involuntary outpatient admission, and persons in need of psychotropic medication or electroconvulsive therapy treatment.

Prohibits courts from ordering respondents with pending felony charges to undergo hospitalization in Department of Human Services mental health facilities unless the Department agrees to the hospitalization program.

Removes previous language that carved out exceptions for penal institution inmates and clarifies the scope of court jurisdiction over individuals requiring mental health treatment regardless of criminal charges.
