HB3442 Summary

• Extends substitute teacher employment in vacant positions from 30 calendar days to 90 calendar days or end of semester (whichever is greater) when district files extension request with regional office of education and provides training documentation.

• Allows districts to employ substitute teachers for up to 30 calendar days per vacant position during emergency situations without licensed teacher under contract, requiring notification to regional office within 5 business days.

• Expands definition of "emergency situation" to include vacancies unfilled due to lack of qualified candidates, in addition to unexpected teacher absences or capacity needs exceeding previous indications.

• Requires districts requesting extensions to document that they are actively seeking qualified candidates and have provided position-specific training including instruction on meeting needs of students with disabilities and English learners.
