Primary contractors on private construction projects exceeding $20,000 (contracts entered after July 1, 2022) are liable for unpaid wages, fringe benefits, and related costs owed by subcontractors at any tier to workers.

Liability covers unpaid wages, fringe or other benefit payments, interest, Department penalties, and reasonable attorney's fees, but excludes liquidated damages.

Exemptions apply to primary contractors with collective bargaining agreements on the project and those performing alteration or repair work on single-family dwellings or single residential units.

Claimants must provide written notice to the employer and primary contractor 10 days before filing a civil action; claims must be filed within 3 years of when wages were due.

Primary contractors and subcontractors must post a notice at job sites summarizing these requirements; failure to post results in a civil penalty not to exceed $250 payable to the Department of Labor.
