HB3545 Summary

• Amends the Health Care Worker Background Check Act to prohibit individuals who fail to report violations to the Department of Public Health from working in direct care positions or accessing patient records unless they obtain a waiver.

• Requires reports of violations to be made no later than 5 days after the incident occurs across multiple sections of the Health Care Worker Background Check Act.

• Creates new aggravated battery offense under 720 ILCS 5/12-3.05 when a person batters a patient at a Department of Human Services facility if the batterer is a DHS employee, classified as a Class 2 felony.

• Creates new aggravated battery offense when a person batters a recipient at a community-integrated living arrangement if the batterer is an employee of that arrangement, classified as a Class 2 felony.

• Adds failure to report abuse, neglect, or misappropriation of resident property to the list of designations that can be included on the Health Care Worker Registry.
