IL HB3553

Establishes civil liability for persons 18 years or older who knowingly and intentionally transmit obscene material via computer or electronic communication device to another adult without consent or after being expressly forbidden from doing so.

Requires that a reasonable person receiving the obscene material would suffer emotional distress; liable parties must pay actual damages or $500 (whichever is greater), plus reasonable attorney's fees and costs.

Courts may issue injunctions to restrain defendants from committing further violations.

Exempts Internet service providers, mobile data providers, online or mobile application operators, transmission services, health care providers acting for legitimate medical purposes, and commercial email from liability under this Act.

Remedies under this Act are cumulative and do not restrict remedies available under other laws.
