HB3593 - Digital Electronic Equipment Right to Repair Act

• Original equipment manufacturers must make available documentation, parts, tools, and training materials to independent repair providers and equipment owners on fair and reasonable terms for repairs sold or used in Illinois.

• Fair and reasonable terms require documentation at no charge (except printing costs), tools at no charge without authorization requirements, and parts at costs equivalent to those offered to authorized repair providers without unnecessary restrictions.

• Violations of the act constitute unlawful practices under the Consumer Fraud and Deceptive Business Practices Act, enforceable by the Attorney General with available remedies and penalties.

• Manufacturers are not required to divulge trade secrets, and the act does not apply to motor vehicles, medical devices, or off-road equipment including farm tractors, construction equipment, and power tools.

• The act takes effect January 1, 2024, and applies to digital electronic equipment sold or in use on or after that date.
