HB3602 - Powered Wheelchair Right to Repair Act

• Original equipment manufacturers must make available documentation, parts, tools, and training materials to independent repair providers and owners on fair and reasonable terms for diagnosis, maintenance, and repair of powered wheelchairs sold or used in Illinois.

• Documentation must be provided at no charge (except reasonable costs for physical printed copies), and tools must be provided free without requiring authorization, internet access, or imposing impediments to diagnosis and repair functionality.

• Parts must be supplied at costs and terms equivalent to the most favorable rates offered to authorized repair providers, without substantial obligations unrelated to repair and without requiring an arrangement with the manufacturer.

• Violations constitute unlawful practices under the Consumer Fraud and Deceptive Business Practices Act, enforced by the Illinois Attorney General with all available remedies and penalties.

• Manufacturers are not required to divulge trade secrets, are not liable for damage caused by independent repairs, and existing authorized repair provider agreements remain unaffected except provisions waiving manufacturer obligations under this Act are void; effective January 1, 2024.
