HB3612 - Carpet Stewardship Act

• Creates a nonprofit clearinghouse to administer a statewide carpet stewardship program, appointed by the Illinois Environmental Protection Agency Director within 60 days of the Act's effective date, with members representing retailers, producers, processors, waste disposal companies, environmental organizations, and installers.

• Requires carpet producers to register with the clearinghouse and provide annual funding to finance collection, processing, and recovery of old carpet starting January 1, 2024, with a minimum goal of achieving a 25% carpet recovery rate by December 31, 2026, and 50% by December 31, 2029.

• Establishes collection site requirements in counties with population density of 100+ people per square mile by January 1, 2024, and 50+ people per square mile by 2025, with clearinghouse payment of $20 per ton recovery fee to approved collection sites.

• Prohibits producers, retailers, and distributors from selling unregistered carpet in Illinois starting January 1, 2024, with civil penalties of $5,000 per day for violations enforced by the Attorney General or State's Attorneys.

• Requires State agencies to purchase at least 35% carpet with minimum 10% post-consumer recovered content by January 1, 2025, increasing by 10% annually until reaching 75%, and establishes a $250,000 annual administrative fee to the Illinois Environmental Protection Agency.
