HB3614 Summary

• Prior to final approval for child placement, the Department of Children and Family Services must request Illinois State Police conduct criminal records background checks of prospective foster or adoptive parents, including fingerprint-based checks of national crime information databases.

• Prospective foster or adoptive parents must submit a full set of fingerprints to Illinois State Police for State and federal criminal records checks against Illinois State Police and FBI criminal history databases.

• Illinois State Police must furnish all Illinois conviction information to the Department following positive identification and may charge a fee not to exceed the actual cost of the records check.

• Final placement approval shall be denied if records reveal felony convictions for child abuse or neglect, spousal abuse, crimes against children, violent crimes including rape or sexual assault, or felony convictions for physical assault, battery, or drug-related offenses within the past 5 years.
