IL HB3751

Expands eligibility for county sheriff deputy and municipal police officer positions to include individuals who are legally authorized to work in the United States under federal law and authorized to possess firearms, in addition to U.S. citizens.

Allows individuals with Deferred Action for Childhood Arrivals (DACA) status who are authorized under federal law to obtain, carry, or purchase firearms to serve as deputy sheriffs, special police officers, and police officers.

Removes citizenship-only requirements from Sections 3-6033 and 3-7008 of the Counties Code, replacing them with alternative eligibility criteria related to federal work authorization and firearm eligibility.

Modifies the Illinois Municipal Code (Sections 10-1-7 and 10-2.1-6) to allow non-citizens with federal work authorization or DACA status to apply for police officer positions, subject to the same requirements and limitations as other applicants except citizenship.

Takes effect January 1, 2024.
