• Adds Section 513b1.5 to the Illinois Insurance Code to regulate pharmacy benefit managers and prohibit steering practices.

• Prohibits pharmacy benefit managers from steering beneficiaries to use only affiliated pharmacies or mail-order pharmacies in which the PBM has an ownership interest or control.

• Forbids PBMs from ordering covered individuals to fill prescriptions or receive pharmacy services from affiliated pharmacies or offering plan designs that require patients to use affiliated pharmacies.

• Prohibits PBMs from reimbursing pharmacies or pharmacists at lower rates than they reimburse themselves or their affiliates for the same products or services.

• Prohibits PBMs from advertising, marketing, or promoting affiliated pharmacies to patients or prospective patients, and authorizes the Department of Insurance to establish additional prohibited steering practices by rule.
