HB3888 - Diversity in Not-for-Profit Act

• Creates the Diversity in Not-for-Profit Act to allow state agencies, counties, and local governments with disadvantaged business enterprise programs to certify minority-led, woman-led, and disability-led not-for-profit organizations.

• Defines certification eligibility requirements: organizations must be tax-exempt under IRC sections 501(c)(3) or 501(c)(4), filed required forms under the Solicitation for Charity Act, and have at least 51% of board members or board members plus key employees from the designated group.

• Amends the Public Utilities Act to include minority-led, woman-led, and disability-led not-for-profit organizations in supplier diversity goal requirements for gas, electric, and water utilities with at least 100,000 customers.

• Requires utilities to report annual procurement goals and spending for diverse suppliers including these not-for-profit organizations, along with detailed plans for increasing participation and vendor engagement.

• Requires state agencies electing to certify organizations under this Act to adopt rules for implementation and maintain lists of certified not-for-profit organizations.
