Raises the threshold for several liability from 25% to 50% of total fault, allowing defendants with less than 50% fault to be severally liable only.

Raises the threshold for joint and several liability from 25% to 50% of total fault, requiring defendants with 50% or greater fault to be jointly and severally liable for all damages.

Expands the definition of total fault to include the plaintiff's employer, nonparties, settled entities, and any other person the trier of fact finds was at fault and a proximate cause of injury or damage.

Applies the changes only to actions filed on or after the effective date of this amendatory act, not to pending cases.
