HB4128 Summary

• Requires employers in Illinois to provide one paid day off on Veterans Day (November 11) each year to employees who are veterans, effective January 1, 2025, if the employee would otherwise work that day.

• Employees must provide employers with at least 30 calendar days' notice of intent to take Veterans Day off and submit documentation verifying veteran status.

• Allows employers to deny the paid leave request only if providing time off would cause significant economic or operational disruption, with mandatory notice to the employee at least 14 days before Veterans Day and a good faith effort to provide a substitute paid day off.

• Creates a 100% income tax credit for employers equal to the full wages paid to veterans for Veterans Day paid leave, available for taxable years beginning January 1, 2025 and later.

• Excess tax credits may be carried forward and applied to tax liability in the 5 following years, applied to the earliest year with available liability.
