HB4135 Summary

• Increases setback distances for commercial solar energy facilities from 50 feet to 500 feet from nonparticipating property lines and from 150 feet to 500 feet from occupied community buildings or dwellings on nonparticipating properties

• Applies to counties in Illinois that establish standards for commercial solar energy facilities under the Counties Code (55 ILCS 5/5-12020)

• Maintains existing setback requirements for wind energy facilities and other siting standards already specified in law

• Allows setback requirements to be waived with written consent of affected nonparticipating property owners
