IL HB4258

Amends the License to Read Act to regulate contracts between publishers and libraries for electronic literary materials (e-books and e-audiobooks).

Prohibits publisher contracts from restricting libraries' customary operations, including licensing from multiple publishers, using technological protections, making preservation copies, or participating in interlibrary loans.

Prohibits publisher contracts from restricting libraries' lending functions, including determining loan periods, setting prices no higher than public retail prices, limiting the number of licenses, imposing per-circulation fees (unless cheaper than purchase), or restricting total loan counts or agreement durations.

Prohibits contracts from restricting libraries' ability to disclose license terms to other libraries or requiring libraries to violate patron privacy under the Library Records Confidentiality Act.

Makes contracts containing prohibited provisions void and unenforceable as unfair and deceptive practices; allows libraries, library officers, and borrowers to bring legal actions for relief; does not affect existing contracts in force before the effective date.
