IL HB4306

Amends Section 11-1.70 of the Criminal Code of 2012 regarding criminal sexual abuse and aggravated criminal sexual abuse involving victims under 17 years of age.

Establishes that a defendant's reasonable belief that a victim was 17 years of age or older remains a defense under Sections 11-1.50(b), 11-1.50(c), and 11-1.60(d).

Prohibits three factors from independently serving as a defense to the reasonable age belief: (1) a statement by the victim claiming to be 17 or older, (2) the victim's presence on a social media platform requiring participants to be 17 or older, and (3) the victim's attendance at educational activities typically attended by those 17 or older such as high school trade programs or community college classes.
