Large public utilities may request expedited review of applications to acquire water or sewer utilities from the Illinois Commerce Commission.

Administrative law judges must rule on expedited review requests within 30 days of application filing, with approval or denial of the expedited timeline.

Utilities seeking expedited review must present evidence supporting necessity, including factors such as infrastructure needing immediate improvements, pending environmental violations, number of customers served, utility operational inefficiency, and safety/reliability concerns.

If expedited review is granted, the Illinois Commerce Commission must issue a final order no later than 5 months after the administrative law judge's ruling.

The Illinois Commerce Commission may adopt rules to implement the expedited review process.
