A ward in guardianship who understands the nature, effect, duties, and obligations of marriage retains the fundamental right to marry without prior consent from the guardian or court approval.

Guardians of wards, the ward, or guardian of the estate may seek judicial approval or ratification of a marriage through a petition to the court.

Guardians may contest the validity of a marriage pursuant to Sections 301 and 302 of the Illinois Marriage and Dissolution of Marriage Act.

Removes previous language requiring court authorization for guardians to consent to a ward's marriage on the basis that the marriage is in the ward's best interests.
