HB4629 - Junk Fee Ban Act

• Prohibits hidden or misleading fees by requiring businesses to clearly and conspicuously disclose total prices in advertisements and at point of sale, with total price displayed more prominently than other pricing information.

• Requires disclosure of the nature and purpose of any fees excluded from the total price (such as taxes, gratuities, and interchange fees) before consumer consent to purchase.

• Exempts retail mercantile establishments and food service establishments from including total price in display prices if they provide notice of consumer fees prior to purchase through reasonable methods (menus, signage, websites, digital displays, etc.).

• Requires food service establishments and retail mercantile establishments to contractually mandate that third-party delivery services comply with fee disclosure requirements, but shields establishments from liability if delivery services fail to comply.

• Establishes enforcement through the Consumer Fraud and Deceptive Business Practices Act, granting the Attorney General authority to pursue violations with all available remedies and penalties; does not limit businesses' ability to charge fees or set prices.
