Requires facility owners to submit a transition plan to the Department of Public Health at least 30 days prior to a change of ownership.

Transition plan must include detailed explanation of how resident care and appropriate staffing levels will be maintained until the new license is obtained and operations are transferred.

Department of Public Health cannot approve any change of ownership without a sufficient transition plan from the transferor.

Failure to provide a transition plan or ensure adequate resident care during ownership change results in high-risk facility designation and penalties assessed at 2 times the maximum normally allowed amount against both transferor and transferee.

Transferor remains liable for penalties including those related to insufficient transition plans during the change of ownership process.
