Director of Labor must adopt rules within 180 days establishing procedures to protect state employees and contractor employees exposed to unhealthy or hazardous particulate matter air pollution based on Air Quality Index (AQI) measurements.

For employees exposed to AQI of 101-250, employers must assess and monitor air quality, provide employee training, implement 2-way communication, and provide NIOSH-approved filtering facepiece respirators for voluntary use.

For employees exposed to AQI of 250 or above, employers must implement all measures for AQI 101-250 plus provide NIOSH-approved respirators for mandatory use and training on proper wear, storage, disposal, and seal-checking.

Procedures do not apply to employees in enclosed buildings with mechanical ventilation systems, employees working from home, employees in firefighting or emergency operations, employees at suspended worksites, or employees with less than 15 minutes per hour exposure (less than one hour total per 24-hour period).
