Prohibits operation of commercial motor vehicles transporting garbage or refuse on highways unless the tailgate is in good repair, operating condition, closes securely, and has a cover or tarpaulin attached to prevent material from escaping.

Reduces the penalty for violations of load cover requirements from $250 to $150 per violation.

Imposes additional $150 fines for persons, firms, or corporations convicted of 4 or more violations of the garbage/refuse transport requirements within a 12-month period.

Exempts highway maintenance vehicles from the new commercial motor vehicle garbage and refuse transport requirements.

Maintains existing requirements that second division vehicles cannot operate with loads of dirt, aggregate, garbage, refuse, or similar materials that are falling, sifting, blowing, or escaping from the vehicle.
