HB5044 Summary

• Amends the Ticket Sale and Resale Act to cap resales of tickets through qualifying internet websites at 40% above the printed face value or box office price, whichever is less.

• Attorney General shall enforce the 40% resale cap provision and may issue fines and penalties to operators who violate it; Office of Attorney General shall adopt rules including penalty amounts.

• The 40% resale cap becomes operative 2 years after the effective date of this amendatory act.

• Maintains existing exemptions for registered ticket brokers, internet auction services, non-profit charity auctions, and websites meeting specific consumer protection and registration requirements.

• Requires ticket brokers and resellers to disclose to purchasers their registration status, refund policy, contact information, and that they are not the official box office before accepting payment.
