IL HB5100

Amends the Illinois Procurement Code Section 50-10.5 to prohibit businesses from bidding on state contracts if the business or any officer, director, partner, or managerial agent has been convicted of a felony under the Sarbanes-Oxley Act of 2002 or a Class 2 or Class 3 felony under the Illinois Securities Law of 1953 for 5 years from the date of conviction.

Requires all bids, offers, vendor portal submissions, and subcontracts to include a certification that the bidder is not barred from being awarded a contract, and authorizes the chief procurement officer to void contracts if certifications are false.

Prohibits persons or businesses from bidding on state contracts if they assisted a state employee with decision-making authority by reviewing, drafting, directing, or preparing invitations for bids, requests for proposals, or similar procurement documents.

Provides exceptions allowing vendors to initiate communications about general information, respond to state employee inquiries about new products or technologies, submit clarification questions about solicitations, bid on industry-trend technology not specifically designed for the state's needs, and conduct construction cost inquiries.
