HB5163 - Database Resources for Students Act

• School districts, state agencies, public libraries, and public universities or community colleges may only offer digital or online library databases to K-12 students if providers verify the resources have safety policies and technology protection measures that prohibit and filter child pornography, obscene materials, and child sexual exploitation materials.

• Providers must prohibit and prevent users from sending, receiving, viewing, or downloading child pornography and obscene materials as defined under Sections 11-20, 11-20.1, and 11-9.1 of the Criminal Code of 2012.

• If a provider fails to comply with these requirements, the institution shall withhold further payments pending compliance verification; failure to timely verify compliance constitutes a breach of contract.

• Each school district, state agency, public library, public university, and community college must submit an aggregate written report to the General Assembly by December 1 each year on any provider noncompliance issues.

• Charter schools are subject to the Database Resources for Students Act as a non-exempt requirement under the Charter Schools Law.
