Governor may declare a disaster exists and exercise emergency powers for up to 30 days without needing legislative approval for the initial proclamation.

After the initial proclamation, Governor may only extend the disaster declaration or issue further proclamations if the General Assembly passes a resolution approving the extension within 5 calendar days.

If the General Assembly fails to pass an approval resolution within 5 calendar days, any extension or further proclamation becomes null and void.

If health or safety concerns prevent the General Assembly from convening, the extension may continue if the President of the Senate, Speaker of the House, and both Minority Leaders submit written certification that the legislature cannot meet.

Actions taken during an extension or proclamation are valid only if the General Assembly approves within 5 days or the leadership certification exception applies.
