HB5226 Summary

• Every school building occupied or to be occupied must be tested for radon by January 1, 2028, and tested every 5 years thereafter (changed from recommended to mandatory).

• All new school buildings must be built using radon resistant construction techniques in accordance with the American National Standards Institute/American Association of Radon Scientists and Technologists CC-1000 standard or successor standard.

• School districts must hire a licensed radon professional to perform confirmatory measurements if radon levels exceed 4.0 pCi/L, and affected buildings must be mitigated within 2 years by a licensed mitigation professional (changed from optional to mandatory).

• School districts must maintain and make available all radon test results for public review and notify parents and faculty of results; the State Board of Education must report all school radon testing results to the General Assembly and Governor every 2 years.

• School districts may use life safety funds for radon testing and mitigation, and home rule units cannot regulate school radon issues in a manner that diminishes radon protections provided by this section.
