HB5304: Highway Work Zone Safety Act

• Illinois State Police shall establish the Highway Work Zone Speed Control Pilot Program to enforce speed limits in construction and maintenance zones using automated traffic control systems.

• Automated traffic control systems use photographic or radar devices to record vehicle speed, capture images of the vehicle and license plate, and display time, date, and violation location without requiring a law enforcement officer to be present.

• Violations result in a civil penalty of $100-$200, with proceeds distributed to the circuit clerk ($10), State's Attorney ($10), Transportation Safety Highway Hire-back Fund ($50), and State Police Vehicle Fund (remainder).

• Photographs and recorded images are confidential, exempt from Freedom of Information Act requests, destroyed within 2 years, and may only be disclosed to vehicle owners, operators, their attorneys, law enforcement, or courts for purposes of collecting the fine.

• The bill repeals the previous Automated Traffic Control Systems in Highway Construction or Maintenance Zones Act and amends the Illinois Vehicle Code to reference this Act.
