HB5322 - Illinois Commercial Algorithmic Impact Assessments Act

• Creates the Illinois Commercial Algorithmic Impact Assessments Act requiring developers and deployers of automated decision tools using artificial intelligence to complete annual impact assessments by January 1, 2026, and every year thereafter.

• Deployers must document assessments covering the tool's purpose, outputs, data types, risks of algorithmic discrimination, safeguards implemented, human oversight mechanisms, and validity evaluation.

• Developers must provide deployers with documentation including known limitations, reasonably foreseeable risks of algorithmic discrimination, types of training data used, and how the tool was evaluated for validity and explainability before sale or licensing.

• Developers must make publicly available a policy summarizing the types of automated decision tools they offer and how they manage risks of algorithmic discrimination in those tools.

• Exempts deployers with fewer than 50 employees unless their automated decision tool affected more than 999 people in the prior calendar year; the Attorney General may request assessments from developers or deployers, with violations subject to injunctive relief and damages.
