HB5467 Summary

• Removes statute of limitations for prosecuting involuntary servitude, involuntary sexual servitude of a minor, and trafficking in persons when victim is under 18 years of age at time of offense, changing from previous 25-year limit to prosecution at any time.

• Removes statute of limitations for prosecuting female genital mutilation when victim is under 18 years of age, allowing prosecution at any time.

• Extends statute of limitations for criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, aggravated criminal sexual abuse, and felony criminal sexual abuse to prosecution at any time when victim is under 18 years of age.

• Allows prosecution for armed robbery, home invasion, kidnapping, or aggravated kidnapping at any time when arising from same course of conduct as qualifying sexual offenses involving minors.

• Requires charging documents to state that statute of limitations is extended and specify the circumstances justifying extension; establishes that prosecution need not prove facts extending limitations at trial if properly pled in charging document.
