IL HB5534

Prohibits a State's Attorney from representing the State in charging and prosecuting law enforcement officer-involved shootings within their county.

Requires the court to file a petition on its own motion alleging actual conflict of interest and appoint a special prosecutor to handle the case.

Mandates the court first contact public agencies including the Office of Attorney General, State's Attorneys Appellate Prosecutor, or other State's Attorney offices statewide to identify available public prosecutors at no cost to the county.

Allows the court to appoint a private attorney as special prosecutor only if no public prosecutor is available.
