Live operators making telephone solicitations must immediately state their name, the name and telephone number of the business or organization being represented, and the purpose of the call.

Live operators must disclose their mailing address and the business or organization being represented on any website they own or operate and on any written communications to customers.

The Act's provisions do not apply to live operators making residential marketing calls in response to a customer's telephone call or website contact if the customer affirmatively requests a follow-up call or contact.

Violations of the Act, including making calls that do not comply with disclosure requirements or continuing solicitations without consent, constitute violations of the telephone solicitations law.

Existing exemptions for autodialers and registered securities professionals remain in effect, with all telephone calls still required to comply with caller ID display requirements.
