Will County may adopt an ordinance regulating vehicle gross weight and axle weight restrictions, with enforcement through automated vehicle weigh-in-motion enforcement systems using roadway scales and motor vehicle sensors.

County or municipality must issue written violation notices to vehicle owners within 30 days of Secretary of State notification but no later than 90 days after the violation, including recorded images, weight readings, violation details, and civil penalty amount.

Civil penalties for violations are capped at $500, plus an additional $500 penalty for failure to timely pay, except when the driver received a Uniform Traffic Citation from a police officer at the time of violation.

Municipalities wholly or partially within Will County may enter intergovernmental agreements with the County to use automated weigh-in-motion enforcement systems within their jurisdictions.

Automated vehicle weigh-in-motion enforcement systems must be posted with warning signs, undergo calibration checks every 6 months by an independent laboratory, and include safeguards to alert the County's transportation department of significant variations from established ranges.

Violations are not recorded on the vehicle owner's driving record and may not be used against the operator in insurance rate determinations.
