HB5826 - Parental Notice of Abortion Act of 2024

• Requires physicians to provide at least 48 hours actual notice (or constructive notice by certified mail) to an adult family member before performing an abortion on a minor or incompetent person.

• Establishes exceptions to the notice requirement including: minor accompanied by entitled person, written waiver, medical emergency, victim declaration of abuse/neglect, or judicial waiver.

• Allows minors and incompetent persons to petition circuit court for judicial waiver of notice requirement; court must rule within 48 hours and may grant waiver if minor is sufficiently mature or notification would not be in their best interests.

• Requires minor's informed consent to abortion except in medical emergencies; defines "adult family member" as parent, grandparent, stepparent living in household, or legal guardian over age 21.

• Imposes penalties including referral to medical board for physicians willfully failing to provide notice and Class C misdemeanor charges for unauthorized persons signing notice waivers.
