HB5891 - Safe Gun Storage Act

• Firearm owners must store firearms in a locked container or secured manner to prevent access by minors (under 18), at-risk persons, or prohibited persons, unless the firearm is actively carried by the owner or authorized user.

• Civil penalties for violations range from $500 for basic non-compliance to $1,000 if a minor/at-risk/prohibited person obtains the firearm, and up to $10,000 if the firearm is used to injure, kill, or commit a crime.

• Courts may order community service or restitution in lieu of civil penalties if good cause is shown.

• Violations constitute prima facie evidence of negligence per se in civil proceedings when a minor, at-risk person, or prohibited person obtains the firearm and causes injury, death, or uses it in a crime.

• The Attorney General or State's Attorney may bring enforcement actions, with collected penalties deposited into the Mental Health Fund; the bill also amends the Criminal Code to update existing child protection firearm storage provisions.
