HB5918 - Artificial Intelligence Systems Use in Health Insurance Act

• Creates regulatory oversight by the Department of Insurance over insurers' use of AI systems and predictive models in making or supporting adverse determinations affecting consumers.

• Prohibits insurers from issuing adverse consumer outcomes regarding denial, reduction, or termination of insurance plans or benefits that result solely from AI system or predictive model use.

• Requires that any decision to deny, reduce, or terminate benefits using AI systems must be meaningfully reviewed by an individual with authority to override the AI system's determination, following Department-established procedures.

• Authorizes the Department of Insurance to adopt emergency rules and establish standards for full and fair disclosure of insurers' use of AI systems.

• Requires all authorized insurers to comply with the Act and all applicable insurance laws, including unfair trade practice and unfair discrimination statutes, when using AI systems for consumer-impacting decisions.
