SB0088 - PFAS Consumer Protection Law Summary

• Names the act the "PFAS Consumer Protection Law" and amends the Illinois Procurement Code to include products without intentionally added PFAS chemicals as "environmentally preferable supplies and services" for state purchasing.

• Prohibits sale or distribution of products containing intentionally added PFAS chemicals in Illinois starting January 1, 2025 for carpets/rugs, fabric treatments, food packaging, juvenile products, oil and gas products, and apparel.

• Extends prohibitions to cosmetics, indoor textile furnishings, and indoor upholstered furniture starting January 1, 2026, and to outdoor textile furnishings and outdoor upholstered furniture starting January 1, 2027.

• Requires cookware manufacturers to label products containing intentionally added PFAS chemicals in handles or food-contact surfaces with a minimum 2-square-inch label in English and Spanish, including website and QR code information about the PFAS chemicals.

• Establishes manufacturer notification requirements to the Environmental Protection Agency with product details, requires fees for administration, and creates civil penalties up to $5,000 for first violations and $10,000 for subsequent violations.
