State Board of Education shall promulgate rules governing the use of isolated time out, time out, and physical restraint in special education nonpublic facilities and public schools, including documentation and reporting requirements.

State Board shall establish a complaint procedure for violations of restraint and timeout rules and include training requirements in certification programs for school personnel.

State Board shall create a grant program (subject to appropriation) for school districts, special education nonpublic facilities, and cooperatives to implement culturally sensitive, trauma-informed practices and positive behavioral interventions to reduce need for isolated time out, time out, and physical restraint.

State Board shall establish goals within 90 days of August 13, 2021, with specific benchmarks for entities to reduce isolated time out, time out, and physical restraint; each entity must create an oversight team and submit annual reports until August 1, 2027.

Entities must develop plans addressing reduction of restraint use, individualized student prevention plans, personnel training on student history, and cultural change toward positive behavioral interventions and de-escalation techniques.
