IL SB1071

Amends the Consumer Fraud and Deceptive Business Practices Act to prohibit consumer reporting agencies from furnishing consumer reports or contact information not requested by the consumer when the report is procured based on mortgage or automobile loan inquiries.

Applies to residential mortgage loans as defined by the Truth in Lending Act and automobile loans covered under the Truth in Lending Act.

Violations of this prohibition constitute unlawful practices under the Consumer Fraud and Deceptive Business Practices Act.

Declares legislative intent for the Act to be enforceable if federal law, including the Fair Credit Reporting Act, does not contradict or preempt it.
