IL SB1434

Amends Section 14-7.05 of the Illinois School Code regarding placement of students with disabilities in residential facilities and educational cost responsibility.

Establishes that any residential facility on another State agency's approval list or that contracts with another State agency shall be automatically considered approved on the State Board of Education's approved residential facility list.

Requires non-approved residential facilities providing educational services to demonstrate proof of appropriate teacher licensure, age-appropriate curriculum, enrollment/attendance data, and ability to implement a child's IEP before school districts are obligated to pay.

Specifies that the placing agency or court must notify the resident school district prior to placement (except in emergencies) and that the resident district remains financially responsible for educational costs while the placing agency remains responsible for residential costs.

Requires placing agencies or courts to refer in-state alternatives to children or parents prior to out-of-state placements and annually review out-of-state placements.
