SB1540 - Vision Care Plan Regulation Act

• Vision care organizations cannot require eye care providers to provide services or materials at plan-set fees unless those services or materials are covered benefits under the plan.

• Providers who reject plan fee schedules for noncovered services must post a specified notice informing patients they charge their normal fee for noncovered items and will provide cost estimates upon request.

• Vision care organizations cannot restrict providers' freedom to choose suppliers, materials, or optical labs, and cannot require purchase of covered materials from sources owned by or affiliated with the plan issuer.

• Plan terms, fees, discounts, or reimbursement rates cannot be modified unless both the eye care provider and vision care organization mutually agree in writing.

• Violations of the act constitute unlawful practices under the Consumer Fraud and Deceptive Business Practices Act, and affected parties may seek injunctive relief and recover attorney's fees and costs.
