Health care providers must review patient files for supplemental policies (Medicare supplement or secondary insurance) before pursuing collection action against insured patients.

If no supplemental policy is found in patient records, providers must notify the patient and allow them to assess bill accuracy, clarify supplemental coverage status, and address payment of unpaid amounts.

After exhausting file review and notification requirements, providers may proceed with collection action only if no supplemental policy is found and payment remains unpaid.

Hospitals must offer charity care information proactively to all uninsured patients regardless of immigration status or residency.

Insured patients must be offered opportunity to request reasonable payment plans for 30 days following initial bill and after supplemental policy review process before collection action proceeds.
