IL SB2285

Amends the Criminal Code of 2012 to replace "Installation of object in lieu of air bag" with "Airbag fraud" and expands the definition and scope of prohibited conduct.

Defines key terms including "airbag," "counterfeit supplemental restraint system component," "non-functional airbag," and "supplemental restraint system" with detailed criteria for each.

Makes it illegal to knowingly import, manufacture, sell, offer for sale, install, or reinstall counterfeit airbags, non-functional airbags, or non-compliant objects; sell devices that falsify airbag diagnostic readings; or sell/lease/transfer vehicles known to contain defective airbags.

Exempts dealership owners and employees, and vehicle owners, from liability if they had no knowledge the airbag or supplemental restraint system component was counterfeit or non-functioning before sale.

Establishes violation of this Section as a Class A misdemeanor, effective January 1, 2024.
