SB2436 Summary

• Creates a new offense of "lewd sexual display in a penal institution" (Section 11-9.2-1) for inmates who knowingly engage in lewd exposure of body or sex organs for purposes of intimidating, harassing, or threatening others; excludes juvenile detention facilities from the definition of penal institution.

• Establishes penalties of Class A misdemeanor for first and second violations, escalating to Class 4 felony for third or subsequent violations of lewd sexual display in a penal institution.

• Provides that persons charged with this offense are eligible for mental health court evaluation and assessment by an independent mental health professional, with charges dismissed upon successful completion of court-ordered treatment.

• Requires the Illinois Criminal Justice Information Authority to compile and report annually (by January 1 each year) data on referrals for prosecution and case dispositions, with penal institutions and county State's Attorneys providing demographic information on referred and charged persons.

• Amends the Sex Offender Registration Act to include third violations of lewd sexual display in a penal institution (committed between the effective date and January 1, 2030) as a sex offense requiring 10-year registration; repeals both the offense and reporting requirements effective January 1, 2030.
