SB2537 - Straw Purchaser Accountability Act

• Creates civil liability for persons who engage in gun trafficking or intentionally/negligently deliver firearms, ammunition, laser sights, silencers, or mufflers to unauthorized persons, straw purchasers, or persons known to use them unlawfully.

• Makes deliverers civilly liable for any subsequent tortious conduct directly or indirectly involving use of the delivered item by any person.

• Prevailing plaintiffs may recover declaratory relief, injunctive relief, costs and attorney's fees, compensatory damages (economic loss, death, injury, medical expenses), and punitive damages if conduct was intentional, reckless, or grossly negligent.

• Establishes joint and several liability for all persons subject to liability and prohibits double recovery under this Act or other statutes.

• Sets 5-year statute of limitations from date of violation or discovery, with limitation period not beginning until plaintiff reaches age 18 and any legal disabilities are removed; standard of proof is preponderance of evidence.
