Public institutions of higher education and State agencies may require value-added resellers to provide manufacturer attestations that goods are offered to all resellers at substantially the same terms, including price, discounts, commissions, rebates, and other incentives.

Any requirement for manufacturer attestations must be clearly included in the bid specifications.

Department of Innovation and Technology and University of Illinois must each include these requirements in at least one information technology hardware procurement during State fiscal year 2025.

Information technology hardware is defined as laptops, desktops, tablets, monitors, docking stations, telephones, headsets, cable cords, computers, servers, and wires.

Bill becomes effective immediately upon enactment.
