IL SB2809

Amends the Unified Code of Corrections to add a new mandatory sentencing provision for first degree murder of a child under age 5 caused by abusive head trauma.

Court shall sentence defendant to natural life imprisonment if defendant was at least 18 years old at time of murder and is found guilty of first degree murder of a child under 5 determined by court testimony to have died from abusive head trauma caused by the defendant.

Defines "abusive head trauma" as head injury caused by shaking, throwing, hitting, slamming, or jerking, which includes shaken baby syndrome.

Defines "shaken baby syndrome" as severe head injury occurring when an infant or young child is shaken or thrown forcibly enough to cause the brain to rebound against the skull.
