• Adds "emergency department staff" as a protected category under aggravated assault and aggravated battery laws, providing enhanced criminal penalties for attacks on hospital and health care facility workers.

• Defines "emergency department staff" to include clinical and nonclinical workers in emergency departments such as physicians, nurses, technicians, security staff, patient transporters, respiratory therapists, housekeeping personnel, secretaries, and pharmacists.

• Defines "health care facility" as facilities licensed under the Ambulatory Surgical Treatment Center Act, University of Illinois Hospital Act, Hospital Licensing Act, Nursing Home Care Act, Assisted Living and Shared Housing Act, or Community Living Facilities Licensing Act.

• Makes assault or battery of emergency department staff a Class 4 felony (same as other protected professionals like peace officers and firefighters) when committed while performing official duties, to prevent duty performance, or in retaliation for performing duties.

• Takes effect immediately upon enactment.
